These Terms & Conditions govern access to and use of the MediSwift24 website, software and related services.
By accessing the website, requesting a demonstration, creating an account, starting a trial or using MediSwift24, you agree to these Terms.
If you do not agree with these Terms, please do not use the service.
1. About MediSwift24
MediSwift24 is a healthcare management software platform designed for healthcare organizations such as clinics, hospitals, pharmacies and other healthcare facilities.
The platform may include features for:
- Patient management
- Appointments
- Consultations
- Prescriptions
- Pharmacy
- Inventory
- Laboratory management
- Billing
- Reports
- User management
- Notifications
- Audit and operational management
- Other healthcare administration functions
Features may change, improve or be discontinued from time to time.
2. Eligibility
MediSwift24 is intended primarily for healthcare organizations and professional users.
You must provide accurate information when creating an account or requesting services.
You must have authority to represent the organization if you create an account on behalf of a clinic, hospital or other healthcare organization.
3. Account Responsibility
Customers are responsible for:
- Providing accurate registration information
- Keeping login credentials confidential
- Restricting access to authorized users
- Assigning appropriate user roles and permissions
- Immediately notifying MediSwift24 of suspected unauthorized access
- Ensuring users comply with these Terms
Customers are responsible for activity performed through their accounts unless caused by unauthorized access attributable to MediSwift24's failure to maintain reasonable security controls.
4. Healthcare Organization Responsibilities
MediSwift24 provides software tools and does not replace the professional judgment of doctors, healthcare professionals or facility administrators.
Customers are responsible for:
- Accuracy of information entered into the system
- Appropriate patient consent and notices where required
- Compliance with healthcare laws applicable to their organization
- Proper use of patient information
- Clinical decisions
- Diagnosis and treatment
- Verification of prescriptions and medical records
- Ensuring authorized personnel use the platform appropriately
MediSwift24 does not provide medical treatment to patients through the website.
5. Patient Data
Healthcare organizations may enter patient and healthcare information into MediSwift24.
Customers are responsible for ensuring that they have the lawful basis, authority, consent or other permission required to collect and process such information.
The processing of customer and patient information may also be governed by a separate Data Processing Agreement.
6. Acceptable Use
Users must not:
- Use MediSwift24 for unlawful activities
- Attempt to gain unauthorized access
- Circumvent security controls
- Upload malicious software
- Interfere with platform availability
- Reverse engineer the software except where permitted by applicable law
- Copy or resell the platform without authorization
- Use another user's credentials
- Misuse patient information
- Use the platform to violate applicable laws or regulations
7. Free Trial
MediSwift24 may offer a 30-day free trial.
During the free trial:
- Certain features may be limited
- Trial availability may depend on the service plan
- MediSwift24 may change or discontinue trial availability
- Customers are responsible for using the trial appropriately
- Unless otherwise agreed, trial accounts do not guarantee continued access after the trial period
Any paid subscription following the trial will be governed by the applicable pricing and subscription terms.
8. Setup and Subscription Fees
Depending on the selected service model, customers may be charged:
- One-time setup/onboarding fees
- Monthly subscription fees
- Other agreed service charges
For local/on-premise installations, customers may instead be charged a one-time installation/setup fee together with applicable yearly service or maintenance charges.
All applicable charges will be communicated to the customer before purchase or activation.
9. Payments
Customers agree to pay applicable charges according to the selected plan or commercial agreement.
Failure to pay may result in:
- Reminder or payment notices
- Temporary suspension
- Restriction of certain features
- Termination after applicable notice
Specific payment terms may be included in the customer agreement or invoice.
10. Software Licence
Subject to payment and compliance with these Terms, MediSwift24 grants the customer a limited, non-exclusive, non-transferable right to use the software during the applicable subscription period.
Customers do not acquire ownership of MediSwift24's software, source code, technology, trademarks or underlying intellectual property.
11. Intellectual Property
MediSwift24 and its associated software, designs, branding, logos, interfaces, code, documentation and content are owned by or licensed to MediSwift24 unless otherwise stated.
Customers retain ownership of their own data.
Customers grant MediSwift24 the limited rights necessary to host, process, transmit, back up and otherwise handle customer data solely to provide the contracted services and fulfill legal or operational obligations.
12. Platform Availability
We aim to keep MediSwift24 reliable and available.
However, uninterrupted availability cannot be guaranteed.
Service interruptions may occur because of:
- Scheduled maintenance
- Emergency maintenance
- Infrastructure failures
- Internet/network failures
- Third-party service failures
- Security incidents
- Events outside our reasonable control
13. Backups
MediSwift24 may maintain backups for operational, security and disaster-recovery purposes.
Backups are intended to support service recovery and do not replace the customer's responsibility to maintain appropriate records where required.
Specific backup and retention arrangements may be described in the customer agreement.
14. Security
MediSwift24 uses reasonable technical and organizational measures to protect the platform and information handled through it.
Customers must also maintain appropriate internal security practices, including:
- Strong passwords
- Appropriate user permissions
- Authorized-user management
- Secure devices
- Timely reporting of suspicious activity
15. Medical Disclaimer
MediSwift24 is a software platform for healthcare management and administration.
MediSwift24 does not independently provide medical diagnosis, treatment or professional medical advice.
Healthcare professionals remain responsible for clinical decisions and patient care.
Information displayed through the platform must be reviewed and verified by qualified professionals where appropriate.
Future AI features, if introduced, will be subject to their own functionality, limitations and applicable requirements.
16. Future AI Features
MediSwift24 may introduce AI-enabled functionality in 2027.
Any such feature may be subject to:
- Separate terms
- Product-specific disclosures
- Additional privacy notices
- Appropriate safeguards
- Human review
- Applicable healthcare and regulatory requirements
Customers must not rely solely on automated outputs for clinical decisions unless the relevant feature is specifically designed, validated and legally permitted for that purpose.
17. Third-Party Services
MediSwift24 may depend on third-party infrastructure, communication, payment, hosting, security or other services.
Third-party services may have their own terms and privacy policies.
MediSwift24 is not responsible for third-party services outside its reasonable control.
18. Suspension and Termination
MediSwift24 may suspend or terminate an account where:
- Fees remain unpaid
- The customer violates these Terms
- The service is being used unlawfully
- Security is threatened
- Fraud or abuse is suspected
- Required by law
- The customer materially breaches the agreement
Customers may cancel their subscription according to the applicable cancellation terms.
19. Data After Termination
After termination, customer data may remain available for a limited period to allow applicable export, backup or legal processes.
After the applicable retention period, data may be deleted or anonymized subject to legal, backup and operational requirements.
Specific procedures should be described in the customer agreement or DPA.
20. Confidentiality
Each party should protect confidential information received from the other party and use it only for legitimate purposes related to the business relationship.
Confidentiality obligations may be further defined in a separate agreement.
21. Disclaimer of Warranties
MediSwift24 is provided on an "as available" basis.
To the extent permitted by applicable law, we do not guarantee that:
- The service will always be uninterrupted
- The platform will be completely error-free
- Every feature will meet every customer requirement
- Third-party services will always be available
- The service will be suitable for every particular purpose
Nothing in these Terms excludes rights or protections that cannot legally be excluded.
22. Limitation of Liability
To the maximum extent permitted by applicable law, MediSwift24 will not be liable for indirect, incidental, special or consequential losses arising from use of the service.
Any contractual limitation of liability should be interpreted together with the applicable customer agreement and mandatory provisions of law.
23. Indemnification
Customers agree to use MediSwift24 lawfully and responsibly.
To the extent permitted by law, customers may be responsible for claims arising from:
- Their unlawful use of the platform
- Unauthorized use of patient information
- Violation of these Terms
- Violation of third-party rights
- Misuse of the platform by their personnel
Specific indemnity obligations may be included in the customer agreement.
24. Governing Law
These Terms are governed by the laws of India.
Subject to applicable law, disputes relating to these Terms shall be subject to the jurisdiction of courts having appropriate jurisdiction over Belagavi, Karnataka.
25. Changes to These Terms
MediSwift24 may update these Terms from time to time.
The updated version will be published on this page with a revised "Last Updated" date.
Continued use of the service after an update may constitute acceptance where permitted by applicable law.
